POWER OF ATTORNEY - KEEPING CONTROL

There is arguably a fear far greater than coming to terms with our own mortality.

Being alive and making our own decisions about our healthcare, welfare and personal financial affairs is something we mostly take for granted.

Unfortunately, life can be cruel and leave us at the mercy of fate if we become severely incapacitated or our mental capacity declines.

Losing personal control can be a fearful prospect! 

As part of their wider estate planning strategy, we therefore encourage clients to consider the creation of a Lasting Power of Attorney (LPA). This applies in England & Wales and can be applied to financial affairs or personal welfare.

LASTING POWER OF ATTORNEY (LPA)

An LPA is a legal document in which you appoint someone you trust as an ‘attorney’ to make decisions on your behalf.

A Lasting Power of Attorney document can be drawn up at any time while you have mental capacity (are still mentally capable) and must be registered with the Office of the Public Guardian if it is to have legal standing. A registered LPA can be used at any time, whether you have the mental ability to act for yourself or not.
