POWERS OF ATTORNEY

TWO TYPES OF LPA - PROPERTY & AFFAIRS
AND PERSONAL WELFARE

These respectively allow you to choose someone to make decisions about how to spend your money, including decisions about the way your property and affairs are managed – and your healthcare and welfare, including consent or refusal of medical treatment on your behalf and deciding where you live. These decisions can only be taken on your behalf when the Lasting Power of Attorney is registered.

There are certain formalities in creating, registering (and cancelling) an LPA and we can guide you through the process.

ENDURING POWER OF ATTORNEY (EPA)

Lasting Power of Attorney replaced Enduring Power of Attorney (EPA) in October 2007. A person given power under an EPA before 1 October 2007 can still use it and apply to have it registered. If you have an unregistered EPA - and you still have the mental capacity to make decisions - you can make a Personal Welfare LPA to run alongside it.

You can cancel an unregistered EPA if you have the mental capacity to do so, without applying to the Court of Protection. To cancel a registered EPA you must apply to the Court of Protection.
